Spousal Support
How Long Does Spousal Support Last in Santa Monica
Duration rules for short and long marriages, and what ends support early
Ask how long spousal support lasts in California and the honest answer is: it depends on one number more than any other. The length of the marriage. Everything else, the incomes, the lifestyle, the careers, feeds into the amount and the fairness of the order. But duration starts with how many years you were married, and the law draws its most important line at 10 years. Here is how that plays out for Santa Monica couples.
The 10 Year Line That Divides Everything
California treats marriages under 10 years and marriages of long duration very differently. For shorter marriages, courts generally aim for support lasting about half the length of the marriage. Married 6 years, expect something in the neighborhood of 3 years of support. That is a planning benchmark, not a guarantee, and judges adjust it based on circumstances. For marriages of 10 years or more, measured from the wedding to the date of separation, the rules change character. Under Family Code section 4330, the court retains jurisdiction over support indefinitely in a long term marriage unless the spouses agree otherwise. There may be no built in end date at all. Support in those cases continues until a court modifies or terminates it, or until one of the automatic ending events occurs.
Short Marriages vs Long Marriages at a Glance
| Under 10 Years | 10 Years or More | |
|---|---|---|
| Typical duration | Often around half the length of the marriage | No fixed end date in many cases |
| Court jurisdiction | Usually ends when the support term ends | Court keeps jurisdiction indefinitely under FC 4330 |
| Purpose of support | A bridge back to self sufficiency | Ongoing sharing of the marital standard of living |
| How it ends | The term expires, or early termination events | Only by court order, agreement, or automatic termination events |
“The 10 year mark is not magic, but it is close. Cross it, and spousal support stops being a countdown and starts being an open file.”
The Factors That Stretch or Shrink the Timeline
Marriage length sets the frame, but Family Code section 4320 fills in the picture, and several of its factors push duration in one direction or the other. Age and health matter enormously. A healthy 35 year old after an 8 year marriage gets a bridge. A 62 year old after a 9 year marriage with health problems may get something much longer. Time out of the workforce counts, because a spouse who spent years raising children does not rebuild a career on the half length schedule. The supported spouse’s documented efforts to become self supporting matter too, and judges expect them. The marital standard of living sets the target, though courts are blunt that both households usually step down after divorce. And the paying spouse’s ability to pay caps everything. Support duration is not an award of permanence. It is a forecast the court revises as facts change.
What Ends Support Before Anyone Expects
Even long term support is not necessarily forever. Remarriage of the supported spouse ends support automatically under California law, and so does the death of either party. Beyond the automatic triggers, cohabitation with a new partner creates a presumption of reduced need that payers can bring back to court. Retirement of the paying spouse at a reasonable age is one of the most common grounds for modifying or ending support in long term cases, and California courts treat bona fide retirement as a legitimate change of circumstances. A significant, documented drop in income works the same way. The thread running through all of these is that nothing changes by itself. Unless an automatic event occurs, the paying spouse must file and prove the change, which is why so many people overpay for years out of pure hesitation.
